Summary
INTRODUCTION
Although “public health ethics” as a concept has existed for less than two decades, political leaders and medical officials have long made moral and value-laden decisions designed to protect the health of the community. History, by revealing the social and cultural forces that inform scientific policies, is an ideal approach for understanding the controversies that have arisen in public health – both before and after they were termed “ethical” in nature (Fee 1993). This chapter will focus on public health ethics in the United States since 1900, drawing, where appropriate, on events that occurred prior to the twentieth century and in other countries. It will highlight a series of controversies that have characterized public health ethics, explicitly noting the relevance of these issues for modern ethicists, health officials, clinicians, and the general public.
In contrast to medical practice, which emphasizes the care of specific patients, and bioethics, which stresses patients’ rights, public health is concerned with health and disease among populations. Although public health interventions are justified in terms of their potential benefit to the populace, they may do so by restricting the liberties of other citizens. Thus, a central theme of public health ethics is the tension between protecting the overall health of such populations and the rights of specific individuals who live in these communities.

As therapeutic advances in the treatment of AIDS began to emerge in the late 1980s and public health began to have more to offer than just the threat, or the perceived threat, of quarantine or partner notification, fissures began to appear in the alliance against named HIV reporting that had emerged a few years earlier. In 1989, New York City’s Health Commissioner stated that the prospects of early clinical intervention warranted “a shift toward a disease-control approach to HIV infection along the lines of classic tuberculosis practices,” including the “reporting of seropositives.”
Although his proposal met with fierce and effective resistance, it is now clear that his call represented part of a national trend. The CDC continued to press for cases of HIV to he reported by name to health departments, an effort that assumed the dimensions of a campaign. It was supported by a growing number of public health officials.

It is one of the remarkable and significant consequence of the AIDS epidemic that out of the context of enormous suffering and death there emerged a forceful set of ideas linking the domains of health and human rights. At first, the effort centered on the observation that protecting individuals from discrimination and unwarranted intrusions on liberty were, contrary to previous epidemics, crucial to protecting the public health and interrupting the spread of HIV But in fairly short order, the scope of the health and human rights perspective expanded dramatically to focus on the ways in which the most fundamental social arrangements rendered individuals and communities vulnerable to HIV Racial and ethnic minorities, those who were marginalized, and women were at risk because of their subordinate status. In the face of such an understanding, nothing short of social change could be adequate to the challenge posed by the AIDS epidemic.

With the identification of HIV as the etiological agent responsible for AIDS in 1984, it became clear that an understanding of the dimensions of the epidemic would require more than a careful detailing of the incidence and prevalence of overt symptoms of AIDS. To enable public health authorities to target and evaluate preventative interventions and plan for the health care services that would be required in the future as the infected progressed to symptomatic conditions, knowledge of the incidence and prevalence of HIV infection was critically needed.

Summary
Liberal individualism has represented a powerful liberating ideological challenge to both the legal moralism that sought to enforce conventional values by state power and the intrusive and restrictive claims of social orthodoxy. The defense of privacy, so central in that confrontation, has defined realms of social life to be protected from coercion and pressure. No reading of the transformations of the past three decades could fail to recognize the achievements of the liberal challenge (Karst 1980). Certainly, the profound, even if fragile, alteration of the moral and legal standards surrounding sexuality and procreation attest to the stunning victory of those who sought to free individuals from intrusive social and public policies. Now that abortion rights, first secured by the 1973 Supreme Court decision in Roe v. Wade, have become so vulnerable to the political currents crystalized by the Court in its 1989 Webster ruling, the achievements of the liberal ascendency during this era seem all the more striking.
AIDS has represented a challenge to the central impulse of liberal individualism, forcing into the social realm matters that had come to be viewed as of no legitimate public concern; it has revealed the limits of the ideology that had provided the wellspring of cultural and political reform. Pediatric AIDS has contributed yet one more element to the broad encounter with the liberal commitment to the sanctity of reproductive choice, encumbered neither by governmental restrictions nor social pressures.

Summary
In 1973, after several years of bitter dispute, the board of trustees of the American Psychiatric Association (APA) decided to remove homosexuality from the Diagnostic and Statistical Manual of Psychiatric Disorders, its official list of mental diseases.
Infuriated by that action, dissident psychiatrists charged the leadership of their association with an unseemly capitulation to the threats and pressures of gay liberation groups and forced the board to submit its decision to a referendum of the full APA membership. And so America's psychiatrists were called to vote upon the question of whether homosexuality ought to be considered a mental disease. The entire process, from the first confrontations organized by gay demonstrators at psychiatric conventions to the referendum demanded by orthodox psychiatrists, seemed to violate the most basic expectations about how questions of science should be resolved. Instead of being engaged in a sober consideration of data, psychiatrists were swept up in a political controversy. The APA, according to its critics, had fallen victim to the disorder of a tumultuous era in which disruptive conflicts threatened to politicize every aspect of American social life. A furious egalitarianism, which challenged every form of authority, had compelled psychiatric experts to negotiate the pathological status of homosexuality with homosexuals themselves. The result was not a conclusion based on an approximation of the scientific truth as dictated by reason but an action demanded by the ideological temper of the times.
To those who viewed the 1973 decision sympathetically, psychiatry had displayed a remarkable capacity to acknowledge the significance of new research findings and to rethink its approach to sexuality.
